We are pleased to launch the Examination of Title Checklist, a downloadable tool to assist conveyancers in the examination of title process and avoid important steps being missed.

The high volume of conveyancing transactions in Scotland and the importance of them to clients mean that they are often the subject of claims on the Master Policy, and many of these relate to aspects overlooked in the examination of title process.

Designed as a helpful aide memoire, the checklist highlights issues such as matrimonial homes legislation and NHBC schemes, alongside more bread and butter issues like access rights or splitting of the benefited property in a servitude.

The checklist was conceived by Ashley Swanson, a solicitor at Fraser & Mulligan, and was his winning entry in the 2021 Innovation Cup.

In April 2018, the Innovation Cup was launched to seek new risk management solutions for law firms and the legal profession. It is run by the Law Society of Scotland, Master Policy lead insurers RSA and brokers Lockton.
